Who Is Responsible for Your Crash: Uber or the Driver?
Most companies are responsible for the negligence of their employees, but Uber is a little different. Uber states that it does not “employ” its drivers. Instead, the rideshare company says that its drivers are independent contractors. That distinction gives Uber limited liability for the car crashes that its drivers cause.
In most car accidents, when another driver is to blame for your crash, you pursue that driver for your damages. In many Uber accidents, that same rule applies, and the driver is held liable rather than Uber. There are a few situations where Uber might share responsibility for the accident.
